1. Introduction

Welcome to PhotoMagic ("we," "our," or "us"). By accessing or using our website and AI-powered image editing services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. Services & AI Disclaimer

PhotoMagic provides AI-based tools for image processing (Background Removal, Sketch-to-Real, Virtual Try-On, etc.).

• AI Output: Our services use advanced Artificial Intelligence (via Replicate/Stable Diffusion). While we strive for high quality, AI generation is experimental. We do not guarantee that every output will be 100% perfect or legally accurate.
• "As-Is" Basis: The services are provided on an "as-is" basis. You acknowledge that AI may occasionally produce artifacts or unexpected results.

3. Accounts & Device Policy (Anti-Fraud)

To prevent abuse of our "Free Trial" system, we employ strict Device Binding technology.

• One Account Per User: New users may receive 20 free credits. Creating multiple accounts on the same device to bypass this limit is strictly prohibited.
• We reserve the right to ban accounts or revoke credits if fraud is detected.
• You are responsible for maintaining the confidentiality of your login credentials (Google Auth).

4. Credits, Payments & Refunds

• Credit System: Services are operated on a credit basis via Razorpay.
• No Refunds on Purchase: All credit purchases are final and non-refundable.
• Automatic Refunds (Technical Errors): If a generation fails due to a server error (e.g., "Failed to fetch"), our system is automatically designed to refund the deducted credits to your wallet.
• Style Preference: We do not offer refunds if you simply "dislike" the aesthetic outcome of an AI-generated image, provided the system functioned correctly.

5. User Content & Copyright

You retain full ownership of the images you upload. We do not claim copyright over your uploads. By uploading images, you grant PhotoMagic a temporary license to process these images through our servers and AI models solely for the purpose of delivering the service to you.

6. Limitation of Liability

To the maximum extent permitted by law, PhotoMagic shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
